There are millions upon millions of websites on the internet. The majority of these site's have poor page rankings. Is your site one of them? Would you like to increase your page ranking? In the early days of the web, search engines would get information about a website from the keywords meta tag. This is no longer true. The reason is that several people began to keyword stuff their meta tags to achieve higher rankings with the search engines. The Search Engines got wise to this and changed the criteria they use when crawling websites. This does not mean you should forego keyword meta tags, it is still good optimization practice to include a keywords meta tag however, this tag alone will not get you a high page ranking.

Before I tell you how you can quickly improve your page rank, I want to touch on Search Engine Optimization. Search Engine Optimization is very important to the success of your website and to getting good page rankings. OK, so how do you get a high page ranking? Did you know that most search engines put a high level of importance on the links to your webpage? When a high ranking website links to your site it will make the search engine take notice. Does this mean that all you have to do is get a lot of incoming links to your website? NO, absolutely not! In fact if you simply go grabbing incoming links from wherever you can you could end up getting your site banned by search engines. The key is to get quality links from high ranking sites. All of your incoming links should be from site's that have something to offer your visitors. In other words there content should be relevant to yours. After all, if you are searching for information on 'computer hardware' you aren't going to be interested in a link related to 'dog grooming' now are you? Another very important point needs to be made before we continue; NEVER use link farms. This is important and bears repeating.. NEVER, EVER use link farm!

First: Go to Google.com and download the Google toolbar. Install the toolbar on your web browser.

Second: Do a search using one of your site's most important keywords or phrases.

Third: Visit one of the first few site's displayed in the search results.

Fourth: Note where it says "PageRank" on your toolbar. The green bar represents the page ranking for the site you are visiting and ranges from 0 to 10.

Fifth: By using this toolbar and searching with your important keyword or phrase you can find a site with a high ranking and relevant content.

Sixth: Look for the contact information for the site you are visiting and send a request for a link to your webpage in exchange for a link to theirs.

Every link you get from a high ranking site will improve your ranking with the search engines.

Be aware, since these are high ranked sites, some will refuse your request. Never fear, there is a solution. Go back to your search engine and this time enter "link:" (without the quotes) followed by the name of the site you just approached for a link. You should only need to enter the site name, not the complete url. The resulting display will show you all of the sites that link to the one you approached. You can now go visit one of those sites and ask for a reciprocal link. While this is a 'backdoor' approach to getting the link you were originally after...it has been known to work.

Here is a little side-note with regard to negotiating for reciprocal links. This was learned during my years as owner of two businesses. In any negotiation the other side has one thing on their mind at all times...."What is in this for me?" When negotiating for reciprocal links you should stress the benefits that the agreement will provide to them. Try to make your offer as attractive to the other side as you possibly can.

It's Never Free

Free this and Free that, everywhere I look something is being offered for free. In my mailbox, in my email, on the radio, and on the TV. whats the catch? In todays mail their was a coupon section and the local Arby's said Free coke but when you look at the fine print this was with the purchase of a sandwich. Another ad said free pizza when you buy a regular pizza you get the second one for free. On Ebay a lot of the ads state free shipping but are they jacking up the price of the item so that they can give you this free shipping?

On the internet there are all the free reports and free ebooks or the one I like is these business opportunities that say free training. There is always a catch though. Like these free reports and ebooks. They either give you just enough information to make you want more or what they are giving you for free is a 'lite' version of what you would be getting if you had bought the paid version. There is always a price.

Remember when we were kids and used to play Monopoly? You could get a "Get out of Jail FREE" card but it had a cost. The cost was you had to go to jail in order to use it. A lot of companies off Free trials for their services and products but with most of them you have to give them your CC details and after the trial is finished they start automatically billing you monthly or even weekly. I have tried to take advantage of these by cancelling on the last day but if you sign up for too many of them 1 might sneak by which has happened to me.

I received one email a few days ago from a friend of mine of this lady who was supposedly broke 13 years ago but now she is making a great income and she wants to show you how to do this. She even goes on to say that she knows what its like to be broke and wants to make her course available to everybody who has wasted all their money with other courses but finally after you give your information you get an email from her with a link on it and the price is just under $1000. This is not five payments equalling this amount but one payment. The question I have is that if she nows how it feels having wasted all of your money on other opportunities and coaching programs then why would we now waste another $1000 on her program after we have been burned so much in the past. The reason she is making money now is because she is selling her course for almost $1,000. So what if she is paying affiliates $500 of that she still has a nice chunk of change left over.

I get so many emails from so many marketers giving away free reports, videos, and MP3s's but the bottom line is they are all just sales letters of some sort. On a lot of the pages they direct you to these are called Squeeze pages where they give you so little info and then if you want to get more you have to give them your name and email address. Once they have this information they now will send you other emails offering you advice but also making offers for other products.

My son, Jacob, heard a radio annexing the other day, actually it was a commercial, but saying how you could get a Free Laptop computer just for answering a few short questions. I visited this site and at first they just get your info and then before you go on they make all these offers. Keep in mind that for every offer you say yes to that you have to fill out another form with a lot more information. After about an hour and a Gazillion questions they took me to a screen saying that I was almost half way there. I closed my browser right away because I did not want to have to fill out offers on another 1,000 pages. I did find out about 2 marketers who used these types of sites to get subscribers, both of them were these No Money down real estate gurus which I'm sure you have seen.

Even free software still has a cost. You may pay almost a $1000 for a Microsoft product but at least the support for the first ninety days won't cost you anything. Free software however offers very little and sometimes no support. I heard a rumor recently that Microsoft was going to be offering low cost or free hosting but then what will they be charging per minute for support?

Sherry and Spanish Tapas - a Match Made In Heaven

There is absolutely nothing wrong with wine, or beer, or anything else that takes your fancy to have with your tapas. But until you try it with sherry, youre missing out on a taste tradition going back thousands of years. The first documented mention of sherry comes from around 1 BC - and that author mentioned original vines brought by the Pheonicians in 1100 BC!

First things first though: the Spanish do not call their wine sherry. This is an anglicised version of the word Jerez (which is pronounced hereth with the accent on the second 'e'). To be considered a genuine sherry a wine must come from the sherry triangle. This is a region on the Atlantic coast of Anadalucia bordered by the towns of Jerez de la Frontera, El Puerto de Santa Maria and Sanlcar de Barrameda. So, no matter what it says on the bottle, anything else is just fortified wine in the style of Jerez.

There are three main types of widely-available sherry: dry, medium and sweet, plus a couple that are a bit different and harder to find. Well cover the main ones first.

The types of sherry.

First we have the dry sherries Fino and Manzanilla. These are pale in colour, bitingly dry and delicately flavoured. The Manzanilla has a salty, nuttier taste. They are primarily served as aperitifs before the meal and with tapas as a starter. However, many Spanish people drink these as a wine throughout the meal. They are very versatile wines which go perfectly with jamn, chorizo, mild cheeses, white fish and all seafood.

Next up comes the medium-dry Amontillado. This is a golden amber colour with a dry but nutty taste. It goes well with poultry and game, robust cheeses and oily fish like sardines and mackerel.

A darker, richer sherry but still a medium is the Oloroso. This is perfect for red meats and stronger game dishes.

Finally comes the dessert sherries : Moscatel and Pedro Ximnez. These are both very sweet and are perfect for desserts and blue cheeses. The Moscatel is a softer wine and the Ximnez is a rich, dark Spanish beauty in a glass!

A couple of options for you to try are a Palo Cortado and a Pale Cream. The Palo Cortado is a rare wine which is a sort of cross between an Amontillado and an Oloroso. Drink it with the richer foods like game, strong cheeses, etc. Youll probably find the Pale Cream more easily available. This is basically a fino that has been sweetened. Its an interesting flavour and goes well with rich pats like foie gras, or try it with fresh fruit and nuts.

A commonly-found sherry is the Cream. This is a dessert wine in the style of the Ximnez but not so rich - or expensive! Try it with sweets, pastries and blue cheeses.

Serving your sherry.

The best sherry glasses are the thin, transparent copitas which are designed especially for the job. They are long-stemmed, to prevent your hands warming the wine, and have a taper towards the top to funnel those subtle and distinctive notes nicely to the nose. Dont fill the glass more than halfway or the wine will not have a chance to blossom and release its aromas as you swirl it around the glass.

If you cant lay your hands on some proper copitas then a champagne flute would be the next-best alternative.

Failing that, just slosh some into a wine glass, you heathen! But better to drink from a wine glass than not to drink at all, thats what I say.

Temperatue.

Fino and Manzanilla should be bought fresh and used quickly, within three months, as they do not last well in the bottle. They should always be served chilled. Once opened, keep in the refrigerator and consume within a couple of weeks. These wines are very delicately flavoured and lose their character very quickly once opened.

Amontillados can be kept in the bottle for two to three years but, again, once opened, should be consumed as quickly as possible. The ideal temperature to drink these is a cool room temperature. However, once theyve been opened you should keep them in the fridge if you dont have a cool place to keep them. Drinking them cold is perfectly acceptable.

The Olorosos, Creams and Ximnezes, being richer and more aged, can be kept in the bottle for years, depending on the quality of the wine. Once opened, they can be kept for months in a cool place, or in the fridge. But bear in mind that they should be served at room temperature to appreciate them at their best. A pale cream, or even a cream, on the rocks is a delicious alternative.

Storage.

Unopened bottles of sherry are very susceptible to oxidisation so should be stored upright, not laid down, in a cool and dark place at an even temperature. All sherries, once opened, should be stored upright with their corks firmly in place to prevent oxidisation and loss of flavour.

There is, of course, a very simple answer to this problem of storage and oxidisation. You simply prepare some tapas little dishes, get a few friends round and open your best bottle of sherry. Then throw the cork away! What better way to enjoy your sherry and tapas the proper Spanish way?

In other words, to paraphrase Harry Truman, it defines where the buck stops, which is at every level of responsibility. A great part of the confusion comes from a lack of distinction between responsibility and accountability. Responsibility refers to the duties to be performed, describing what should be done without specifying how well or how timely tasks should be performed. Responsibility is an action, accountability is a result (compared to standards).

The next logical question is: Who are we accountable to? Responsibility and accountability by their nature infer a relationship. The answer to the question is; our stakeholders. Stakeholders are individuals or organizations who are involved in or may be affected by the activities of the enterprise. There is a diversity of stakeholders within any enterprise or organization. Each stakeholder has a different and unique need that must be met by the organization. For example, an employee has a need for security, a paycheck, and a safe working environment. On the other hand, an investor has a need for a reasonable rate of return on their investment. A customer has a need for a quality product or service that provides value. The local government has a need for tax revenues and so on.

The business community has failed at the point of the stakeholder, because it has taken an unbalanced approach to meeting stakeholder needs. For business to be successful, it must be accountable at all levels to all of the various stakeholders. For many years, business has focused on meeting the needs of the investors rather than meeting the needs of all of the stakeholders. For example, a company decides to cut costs to drive up its perceived value to investors, and lays-off 1,700 employees. What is the impact on the stakeholders? Investors see improved cash flow and reduced liabilities, thereby making the perceived value of the company stock greater. The CEO realizes increased value to their assets (stock and stock options). The laid off worker is out of a job and realizes diminished value to their assets. The retained worker realizes greater demands on their time, decreased quality of work life and home life, greater stress, etc.

The impact on the organization is greater turnover (voluntarily and involuntarily) which drives costs up, increases waste, reduces effectiveness, and in many cases loses customers. The myopic view of stakeholders is threatening the long-term viability of the enterprise or organization.

Business needs a fresh look at how it is conducting itself in order to re-establish the trust of its stakeholders. A few arrests wont do, new laws wont do, and the words of our politicians wont do. We need to re-think our business structures in terms of true accountability to our stakeholders ALL of our STAKEHOLDERS! This requires reinvent our business in such a way that it is accountable at all levels. Accountability must be linked throughout the organization to its strategic purpose, its vision and values, and to all of the stakeholders.

Accountability requires a commitment from all parties. That commitment must be based upon an obligation to obtain predetermined results in a given activity. Such commitment will only come when both parties have a say in building the accountability. Such accountability does not just happen, it requires a system.

Any such system must take into account the obligations that all enterprises or organizations have to their stakeholders. Without an obligation, there can be no accountability. In business there are five fundamental obligations, they include:

* Survival obligation
* Essential work obligation
* Principal markets obligation
* Principal product obligation, and
* Principal territory obligation.

These obligations exist at all levels of the organization, though they may be stated a bit differently at each level or from department to department. They drive the companys mission as well as its strategic purpose. The five fundamental obligations provide the basis for defining the work in terms of Continuing Vital Activities. These activities, which if not performed according to certain standards, could impair overall operating results.

Continuing Vital Activities (CVAs) are the framework within which realistic and achievable objectives are developed. They help focus the work so that objectives reflect what needs to be done (results based objectives), rather than what will ensure that bonuses are obtained (permissive objectives).

We need to change from the system of permissive objectives that many organizations have fallen victim to one that links concrete results to the obligations that the organization has to the stakeholders. These objectives require that standards be applied to ensure that the necessary results are obtained. The greatest barrier to effective results oriented objectives is a resistance by managers and subordinates alike to define appropriate standards. Standards development must be a part of any accountability system if it is to succeed.

There is a program available for building a true accountability system within an organization - it is called the Accountability Focused Management system provided by The ALERA Consulting Group, Inc. The Accountability Focused Management system provides a systematic structure built upon the five fundamental obligations. It creates an atmosphere of mutual commitment to those obligations by both management and personnel. * Put in the amount of milk you need for your coffee.

* Then raise the milk jug so that the steamer wand falls well below the milks surface.

* Open the steam valve, and raise the steamer wand so it sits just below the milks surface. You don't want to create large bubbles, so somewhere around 1cm (or 2/5 inch) under the milk surface will be fine.

* As the milk rises move the steamer wand accordingly. Remember your aim, smooth velvety frothing milk, not big bubbles.

* Once you have built a velvety surface, push the steamer wand deeper into the milk and continue to heat the milk.

* Wait until the milk jug is hot to touch, not warm, HOT, you should have hot velvety frothing milk.

* Then just pour into your espresso to complete a great cup.

I was recently taking a little R&R with my parents in Las Vegas. While I am not a big gambler, I thought I would do an experiment.

I decided to use the same rules that are essential for profitable trading and apply them to gambling.

Rule 1: Choose the right game. In gambling you need focus on a particular game that that is easy to play and understand. The same is true in trading. You should never trade markets that you don\'t understand and are difficult to trade real-time. I think alot of traders trade something just because it is popular. That is very foolish as you can have your head handed to you if you don\'t know what you are doing.

Rule 2: Choose a bet size that is within your comfort level. I decided on a bet(unit) size of $1. To some of you that may be small, but I chose this amount simply because it is nothing to me and I know that my emotions would not affect the game over this small amount of money.

Many traders downfall lies in betting too big!

Take forex traders for example, when they trade a regular sized forex contract each point(pip) is worth $10.00. If they lose just 20 pips on a trade, that is $200 and that may be way too big both financially and psychologically for the trader to stomach. As a result they start trading out of fear and anxiety and make a lot of mistakes.

If this sounds like you, then by simply switching to the smaller mini forex contract where each point(pip) is worth just $1.00 you may find that all your anxiety is gone and that you trade easily and confidently.

Rule 3: Choose your \"windows of opportunity\" wisely. In every casino there are hundreds of slot and poker machines all trying to grab your attention to get you to play.

When I look for a machine that can give me a \"window of opportunity\" I have 2 criteria.

First, I only look for video poker machines because you can apply certain strategies that can increase your odds. Second, I always look for ones near the casino entrance area as these machines are often programmed to pay out more frequently so that they attract attention and lure gamblers into the casino.

Now in contrast, lets look at how my Father picked a game. He had no rules and was sucked into the first machine that grabbed his attention. In addition, he would choose regular slot machines which didnt allow for any strategies and would play machines that were in the middle of nowhere. Time after time he would lose all his money on these machines.

In trading you must pick your market wisely too. How do you do this? Only trade markets you can afford to trade and also make sure you understand all the rules and nuances of it.

Rule 4: Money management - Use a stop loss. In each new game I would start with the same $100.00 buy in which gave me 100 - $1 units. If I lost 30 units I would end the game and take a break.

Many traders have no set money management plan before they get into a trade and just wing it. You absolutely must know what your risk is before you enter the trade and use protective stops to protect your capital.

Rule 5: Getting a read on the game. I know from experience that when a machine is really hot I will be profitable practically right away and it will pay out often. These characteristics give me important clues to games that want to stay in until I hit my win target.

In trading what often happen is that when the trader is quickly profitable they get really excited and at the same time nervous. This is because they are so worried about losing all the time, that they get the overwhelming desire to get out of the trade and lock in some profit.

The problem with this is that they never ride the trade up far enough and to succeed at this game you have to fight the urge to bail out of a winning trade. You must learn to stick with a profitable trade so that you can lock in some big trades. It is the only way to succeed as it will make up for all your losses.

On the other hand, I would leave if the machine wasnt paying out quickly. Sometimes I would sit there for 15 minutes and keep winning a few and losing a few. After all this effort I would still not be above my starting buy-in amount.

This type of game was a sure sign that things were not going my way and probably wouldn\'t do so either. When I am in this situation I will walk away. When faced with this situation the average gambler will convince himself his luck will change. This is rarely the case as the casino usually gets the last laugh!

In my trading courses I teach that if a trade doesnt go your way within 5 bars it is more than likely going to turn into a loser. The reason is that there is no momentum. When you observe this type of market behavior then it is usually better to exit the trade and wait for a new setup.

Rule 6: Money management - Setting a stop win. When you are in Las Vegas everyone has the Las Vegas Mentality. They think that when they start winning that their luck will continue and they are going to get rich. This is exactly the stupidity that the casinos count on as they know the longer a gambler stays at the table the less likely the odds will stay in his/her favor.

It was interesting to watch my Father play as he has the Las Vegas Mentality and on many occasions he would have a nice profit and I would tell him to walk away. He would always say, Just a bit longer and I constantly watched him lose not only his profit but his entire buy-in amount as well.

When you trade you must have a Stop Win strategy. What this is is a pre-determined profit objective for you to exit at. For example it could be when you are up 5% or $200 or 15 points etc. It could be when the market hits a particular price level. For example, say you buy a stock at $10.00; you would tell yourself ahead of time that if it hits $11.00 then you are getting out. Your strategy cousl also be based on using a trailing stop.

You absolutely must decide what your Stop Win strategy is before you get into the trade!

My Stop Win strategy for the poker machines was 50 units. Anytime I was above this level I would simply cash out and take a break. For example, I got real lucky in one game and hit for 220 units on one hand and another time I hit for 1240 units. In each instance, I took the money and ran.

After 3 days in Las Vegas, it was interesting to see how I had a very profitable experience while my Father had the exact opposite. The only difference between us was that I had rules and he didnt.

Car Repair Prices: The Dim Underworld Of Automotive Service

Most know the most glaring auto repair pricing abuses: Service centers overcharging $100s even $1000s for repairs, or charging for repairs that were never done at all.

To be sure, this still happens every day. However, there are many other techniques which involve flying just low enough to avoid detection.

The savvy service centers increase the price so as not to set off any alarms. It has become so common that its not just an accepted industry practice, but even service customers have accepted paying higher prices.

Knowing how ingrained price-gouging is within the automotive service industry, its shocking (although understandable) that even service customers have succumbed to excessive car repair prices. I frequently hear service customers state:

Yeah, I know I was ripped off, but my cars fixed now. Or, I know they charge too much, but theyre convenient.

This is insane! To accept auto repair price-gouging is to allow its continuation. The difficult part, of course, is how to stop it. Given that the automotive service industry is so big and powerful (and so frightfully necessary) how does one battle such a force?

Perhaps the first thing to understand is the degree to which this type of stealth-like price-gouging occurs. A two-decade undercover investigation has revealed that 98% of all repair shops (dealerships, local shops, and franchises) are price-gouging their customers in one form or another.

The following exchange, between a service manager and service advisor, provides an idea of the scope of scamming below the radar.

A service advisor asked his manager how to bill more hours per month, which is another way of asking how the advisor can make more money. The service manager casually stated:

Simply add an additional two tenths to every ticket you write.

In other words, every customer this service advisor helps, he was instructed by a superior to add a little extra. So if the labor rate is $100 per hour two tenths would equal $20. Rather than pay $100 per hour, the service customer would actually pay $120.

$20 doesnt sound like much compared to the gross injustices we all know. However, whether its an overcharge of two cents or $20, its too much.

If you visit a shop practicing this strategy alone (there are hundreds of strategies, many applied simultaneously), you may end up paying over a $100 or more by years end.

Whats really shocking is that being ripped off $100 over a years time is actually minor!

That Vital Opening Statement

Many inexperienced speakers rush their presentations because of that fear and dread of standing up in front of a live audience. They cannot wait to bring it to a close.

As long as the message has been delivered and reinforced (usually by distracting and overloaded PowerPoint slides) that's the job done. Thinking about how to win over the audience is the last thing on people's mind but it is absolutely crucial.

It's vital to get the audience on board immediately, otherwise they'll have switched off in the first 5 minutes; that should be regarded as a catastrophe, but regrettably it is alarmingly common.

In recent years I have made a point of asking people what they thought about a presentation that we have all sat through and it is truly horrifying how many people very quickly went off into their own dream world, so dull was the presenter.

It is not uncommon for 100 people to sit through an hour's presentation and only 10 to be still listening after a few minutes imagine all that lost working time.

What are the steps to winning over an audience?

Good audience reconnaissance is never wasted. Find out who they are and what are their expectations.

Imagine a politician addressing an audience of business people all of whom are running small independent operations and that politician's opening remarks being Red tape is strangling this country and impeding the ability of our entrepreneurs to thrive. We will reduce this burden at a stroke by taking the following actions '.

So long as the key message was congruent and beneficial, the audience would be convinced. The rest of the speech will now be so much easier to deliver.

Compare this to a speaker with an audience comprised solely of people working within finance departments being greeted with the remarks this initiative will allow us to reduce those working in finance areas by 50%'. It's not surprising that this is resisted at all costs!

Secondly - when you deliver this audience winning statement look them straight in the eye as you say it and see how the audience rapport builds as they look back at you. Feel the bond forging between the two of you as they do.

Thirdly - when you have finished delivering that winning statement pause briefly to allow the audience to absorb the statement and quite possibly shake their head in agreement.

Fourthly, rhetorical questions is a useful technique to passively engage the audience.

Finally, and for speeches lasting over 10 minutes; use humour to lighten the mood. This will ensure that the attention of the audience never drifts off.

Knowing that you have won an audience over is one of the best feelings in the speaking world.

Introduction To .UK Domain Disputes

The .uk registry is the worlds fourth largest (after the .com, .org and .de registries). It is administered by Nominet, a not-for-profit company based in Oxford, England. Nominet acts not just as the .uk registry, but also as the .uk dispute resolution service provider.

Nominet does not use the UDRP for dispute resolution, but has instead created a distinctive system inspired by the UDRP. The substantive rules governing .uk disputes are set out in Nominets dispute resolution policy document (referred to below simply as the "Policy") and its dispute resolution procedure document.

Procedural rules

The Nominet dispute resolution procedure is a close relative of the UDRP procedure. However, there are some important differences.

There is a free mediation service built in to the Nominet procedure. The mediation process involves a neutral third party who tries to bring the complainant and respondent to agreement through "shuttle diplomacy". If the parties can resolve their dispute before the mediation period comes to a close, Nominet waives its fee.

Another distinctive feature of the Nominet procedure is the possibility of appealing an expert's decision (in Nominet proceedings, panellists are called "experts"). By contrast there is no appeal other than to a court of law from a decision under the UDRP or the EURid rules.

A single expert always decides "first instance cases". Should either party appeal the first instance decision, a three member panel will be appointed to decide the appeal. At the time of writing, there have only ever been six appeals.

The Nominet fee is always paid by the complainant. At present, that fee stands at 750 plus VAT. There is also a fee of 3000 plus VAT payable by a person invoking the appeal procedure.

The remedies available are cancellation or transfer. Unlike in UK litigation, there are no provisions for the unsuccessful party to pay the successful partys costs.

Substantive rules

Basic rule is that: "A Respondent must submit to proceedings under the Dispute Resolution Service if a Complainant asserts to us, according to the Procedure, that: (i) The Complainant has Rights in respect of a name or mark which is identical or similar to the Domain Name; and (ii) The Domain Name, in the hands of the Respondent, is an Abusive Registration." (Paragraph 2(a) of the Policy.)

"Rights" are treated in a similar way to rights under the UDRP: the test is not a difficult one to meet.

The idea of an "Abusive Registration" maps imperfectly on to the concepts of legitimate interest and bad faith under the UDRP.

Rights in a name or mark

Paragraph 1 of the Nominet Policy provides that: "Rights includes, but is not limited to, rights enforceable under English law. However, a Complainant will be unable to rely on rights in a name or term which is wholly descriptive of the Complainant's business."

In practice these rights are often rights arising out of registered UK or Community trade marks.

However, the rights can also be rights in the tort of passing off. This is a complex subject, but most experts will be prepare to accept that a complainant has unregistered trade mark rights which could give rise to an action in passing off where the complainant can show substantial use of a mark or name as a trade mark in the UK. It is probably fair to say that the standard of proof required by Nominet experts of these unregistered rights is significantly lower than that required by the English courts in a passing off action - although in passing off cases the evidence is usually being used to prove a different point.

Rights can also mean contractual rights e.g. where one person has contracted with another to transfer the domain, but then refuses to do so.

which is identical or similar to the domain name

Because most Nominet experts have at least some expertise of trade mark law, the concepts of identity and similarity are heavily conditioned by the comparable concepts in trade mark law.

As regards identity, the domain name extensions are ignored, so that the trade mark MERCEDES is identical to the domain name mercedes.co.uk. Similar formal differences (e.g. the use of hyphens in a domain name in place of spaces) should not upset a finding of identity.

Similarity is more difficult. In European trade mark law there is a concept which may be called "confusing similarity", and it is this concept which experts are accustomed to apply when comparing one mark to another. The question is: would the public be confused by the use of the marks or names, or associate one with the other. Judging by the detail of experts decisions, a similar question is often asked in .uk domain name dispute arbitrations.

Abusive registration

"Abusive Registration means a Domain Name which either: (i) was registered or otherwise acquired in a manner which, at the time when the registration or acquisition took place, took unfair advantage of or was unfairly detrimental to the Complainant's Rights; OR (ii) has been used in a manner which took unfair advantage of or was unfairly detrimental to the Complainant's Rights." (Paragraph 1 of the Nominet Policy)

Note that the abuse can take place either at the time of registration/acquisition or subsequently. In either case, the key ideas are those of taking "unfair advantage of" or being "unfairly detrimental to" the complainants rights.

Proving an allegation of abusive registration

A non-exhaustive list of factors which may be evidence that the domain name is an abusive registration is set out in paragraph 3(a) of the Nominet Policy:

"(i) Circumstances indicating that the Respondent has registered or otherwise acquired the Domain Name primarily: (A) for the purposes of selling, renting or otherwise transferring the Domain Name to the Complainant or to a competitor of the Complainant, for valuable consideration in excess of the Respondent's documented out-of-pocket costs directly associated with acquiring or using the Domain Name; (B) as a blocking registration against a name or mark in which the Complainant has Rights; or (C) for the purpose of unfairly disrupting the business of the Complainant;

(ii) Circumstances indicating that the Respondent is using the Domain Name in a way which has confused people or businesses into believing that the Domain Name is registered to, operated or authorised by, or otherwise connected with the Complainant;

(iii) The Complainant can demonstrate that the Respondent is engaged in a pattern of registrations where the Respondent is the registrant of domain names (under .uk or otherwise) which correspond to well known names or trade marks in which the Respondent has no apparent rights, and the Domain Name is part of that pattern;

(iv) It is independently verified that the Respondent has given false contact details to us; or

(v) The domain name was registered as a result of a relationship between the Complainant and the Respondent, and the Complainant: (A) has been using the domain name registration exclusively; and (B) paid for the registration and/or renewal of the domain name registration."

Because of paragraph 3(c)(i) of the Policy, it is unwise to offer to sell the domain to a trade mark owner where there is a dispute or the potential for a dispute. Another effect of that paragraph is that it is easier for a complainant to prove his or her case where a domain name is used commercially. For this purpose, commercial use includes serving pay-per-click advertising or carrying affiliate links.

Paragraph 3(c)(v) is designed to deal with the all-too-common situation where an employee of a company (often in the IT department) or service provider to a company (often a web developer) registers domain name reflecting the company's trade marks, and then refuses to transfer the domain name when a dispute arises.

Disproving an allegation of abusive registration

A non-exhaustive list of factors which may be evidence that the domain name is not an abusive registration is set out in paragraph 4(a) of the Policy:

"(i) Before being aware of the Complainant's cause for complaint (not necessarily the 'complaint' under the DRS), the Respondent has: (A) used or made demonstrable preparations to use the Domain Name or a Domain Name which is similar to the Domain Name in connection with a genuine offering of goods or services; (B) been commonly known by the name or legitimately connected with a mark which is identical or similar to the Domain Name; (C) made legitimate non-commercial or fair use of the Domain Name; or

(ii) The Domain Name is generic or descriptive and the Respondent is making fair use of it;

(iii) In relation to paragraph 3(a)(v) [registration as a result of a relationship between the parties]; that the Registrant's holding of the Domain Name is consistent with an express term of a written agreement entered into by the Parties; or

(iv) In relation to paragraphs 3(a)(iii) and/or 3(c) [pattern of abusive conduct]; that the Domain Name is not part of a wider pattern or series of registrations because the Domain Name is of a significantly different type or character to the other domain names registered by the Respondent."

Paragraph 4(a)(ii) is arguably one of the most important in the Policy. Controversially, some experts have read this rather narrowly, such that domain names which are 100% descriptive of the business in which they are being used are being transferred to complainants in circumstances where it would be extremely difficult if not impossible to put together a credible case in the High Court.

Conclusions

The Nominet procedure is inexpensive and efficient, and the quality of expert decision-making tends to be reasonable. However, the procedure is by no means perfect: it is a blunt instrument and from time to time decisions are issued which seem unfair, at least inasmuch as they represent a significant extension of trade mark owners' rights over the position in trade mark law. Moreover, the very fact that there is a distinct set of rules governing .uk domains (and a distinct dispute resolute procedure) means that, where a dispute involves other domain name extensions as well, there is extra expense.
